Mr. Hughes has been a practicing ERISA and employee benefits lawyer since August of 1975, less than one year after the ink was dry on the landmark legislation known as ERISA, an acronym for The Employee Retirement Income Security Act.  After starting his legal career as in house counsel for an actuarial and benefits consulting firm, Mr. Hughes joined a growing Pittsburgh law firm of eight attorneys and shortly became a partner leading the firm’s premiere employee benefits practice representing hundreds of benefit plan sponsors in cutting edge employee benefit designs and in employee benefit controversies involving both government enforcement agencies (IRS, DOL and PBGC) and private claims and controversies.  In 1994, Mr. Hughes moved to Albuquerque, New Mexico to continue his practice and expand it to include many health care legal issues representing physicians and hospitals and other health care providers in corporate and business matters and in employee benefit cases related to the delivery of health care through ERISA regulated group health plans.  From 1998 through 2009, Mr. Hughes continued his ERISA and Benefits practice, mostly as a solo practitioner or special counsel attorney, from locations in New Mexico, Pittsburgh and now St. Petersburg, Florida, depending on the weather and the proximity of his 4 grandchildren.

 While Mr. Hughes maintains an active license to practice law and continues to consult with employee benefit stakeholders, his practice has now evolved primarily to a non-representational and non-adversarial practice as an Independent ERISA Fiduciary and a dispute resolution “neutral”  acting as an arbitrator, mediator or settlement facilitator in cases where the depth of his ERISA subject matter experience coupled with his experience and training as a unbiased neutral can lead to the prompt, fair and economical resolution of ERISA and employee benefit disputes.  In his role as an Independent ERISA Fiduciary,  Mr. Hughes in neither formally nor informally affiliated with any persons or organizations which earn revenues from the investment or management of employee benefit plan assets.  He is not a “broker,” an “investment advisor” or a “financial advisor.”  He sells nothing but his professional fiduciary services on a pure “fee for service” basis – No commissions, rebates, “revenue sharing” or other arrangements which would conflict with his statutory duties as an ERISA fiduciary acting solely in the interest of plan participants and beneficiaries.
